Azerbaijan’s Constitutional Court considers the dissolution of Parliament and appointment of snap elections to be in accordance with the Constitution -UPDATED-2

On June 27, a meeting of the Plenum of the Constitutional Court of the Republic of Azerbaijan was held, APA reports.

At the meeting, in accordance the Decision dated June 21, 2024 "On appeal to the President of the Republic of Azerbaijan on the scheduling of early elections to the Milli Majlis of the Republic of Azerbaijan", the request of the President of the Republic of Azerbaijan the dissolution of the Milli Majlis of the Republic of Azerbaijan and the shceduling of snap elections were considered in accordance with the Constitution of the Republic of Azerbaijan.

The chairman of the Constitutional Court, Farhad Abdullayev, opened the meeting and revealed the composition of the Plenum and briefed about the issue under discussion.

The requesting party was represented by Rustam Gasimov, Head of the Legal Policy Issues Sector of the Department of Legislation and Legal Policy of the Presidential Administration while the responding party was represented by Farid Hajiyev, Head of the Azerbaijani Parliament's administration. Nasib Shukurov, Associate professor of the Department of Constitutional Law of the Faculty of Law of the Baku State University, Doctor of Philosophy in Law joined the session as an expert.

After speeches, the members of the Plenum of the Constitutional Court of Azerbaijan went to the consultation room to make a decision on the issue on the agenda.

After returning from the consultation, Chairman of the Constitutional Court Farhad Abdullayev announced the Decision of the Plenum of the Constitutional Court of the Republic of Azerbaijan.

The decision states that the decision of the Milli Majlis of the Republic of Azerbaijan dated June 21, 2024 "On the appeal to the President of the Republic of Azerbaijan on the appointment of extraordinary elections to the Milli Majlis of the Republic of Azerbaijan" and the dissolution of the Milli Majlis by the President of Azerbaijan and the scheduling of snap elections on the basis of this decision must be considered in accordance with Article 98/1 of the Constitution of the Republic of Azerbaijan.

The adopted decision enters into force from the moment it is announced, it is final, it cannot be canceled, changed, or officially interpreted by any body or person.

Thus, the meeting of the Plenum of the Constitutional Court was declared closed.

At the meeting, in accordance with Clause 1 of Part III of Article 130 of the Constitution of the Republic of Azerbaijan and Article 7.1 of the Law "On the Constitutional Court", and based on the Decision of the Milli Majlis of the Republic of Azerbaijan No. 1174-VIQR dated June 21, 2024 "On appeal to the President of the Republic of Azerbaijan on the scheduling of early elections to the Milli Majlis of the Republic of Azerbaijan", the request of the President of the Republic of Azerbaijan regarding the compliance of the dissolution of the Milli Majlis of the Republic of Azerbaijan and the scheduling of early parliamentary elections is being reviewed with the participation of the parties.

The chairman of the Constitutional Court, Farhad Abdullayev, opened the meeting and revealed the composition of the Plenum and briefed about the issue which is under discussion.

In accordance with Clause 1 of Part III of Article 130 of the Constitution of the Republic of Azerbaijan and Article 7.1 of the Law "On the Constitutional Court", and based on the Decision of the Milli Majlis of the Republic of Azerbaijan No. 1174-VIQR dated June 21, 2024 "On appeal to the President of the Republic of Azerbaijan on the scheduling of early elections to the Milli Majlis of the Republic of Azerbaijan", the request of the President of the Republic of Azerbaijan regarding the compliance of the dissolution of the Milli Majlis of the Republic of Azerbaijan and the scheduling of early parliamentary elections will be reviewed with the participation of the parties.
